The Trump administration filed an emergency petition asking the Supreme Court to allow it to resume border wall construction in the Big Bend region.
Biden stopped border wall construction in most areas when he took office in 2021.
The Trump administration returned to the Supreme Court on Wednesday afternoon, asking the justices to allow it to resume construction of its border wall in the Big Bend region of southwestern Texas. U.S. Solicitor General D. John Sauer called the order by a federal trial judge in El Paso temporarily halting the construction “baseless” and “unprecedented.”
During President Donald Trump’s first campaign and his first term in office, his efforts to build a wall along the U.S. border with Mexico were a central part of his immigration agenda. President Joe Biden largely stopped construction when he took office in 2021.
Under the Illegal Immigration Reform and Immigrant Responsibility Act of 1996, the Secretary of Homeland Security has the power to “waive all legal requirements” necessary “to ensure expeditious construction” of border walls and roads. Moreover, federal courts can only hear challenges to such waiver decisions if they allege a violation of the Constitution.
A US District Judge granted a preliminary injunction filed by groups to stop the border wall from being built.
This impacts around 500 miles of border wall.
Earlier this month, U.S. District Judge Kathleen Cardone granted a preliminary injunction in a lawsuit filed by multiple groups to halt the Department of Homeland Security from building a border wall and barriers system in the Big Bend region of southwest Texas. She ordered DHS to halt building “border barrier or related infrastructure, or engage in any construction or ground disturbing activities, in the Big Bend Sector until and unless Defendants comply with all applicable laws,” The Center Square reported.
The order impacts roughly 500 miles of the southwest border where illegal crossings have historically been the lowest in Texas and the entire southwest border. Under the Biden administration, illegal entries reached a record high in the region but were still the lowest in Texas and across the southwest border, The Center Square reported.
Trump is keeping his promises!
